Robert Arroyo pleaded guilty to murdering Courtney Nichole Arroyo, but his lawyer will try to convince the jury Arroyo is guilty of the lesser charge of manslaughter.
“We’re going to ask the jury to take into consideration the history of his experience with his marriage,” defense attorney Wayne Meissner said.
The jury could give Arroyo as little as two years probation if they find him guilty of manslaughter, Meissner said.
But could face as much as life in prison if he is found guilty of murder.
Arroyo, then 51, picked up 28-year-old Courtney Arroyo, from the Victoria County Jail on July 17. Later that day, Arroyo took his wife’s body to the Robstown Police Department. He told officers there he choked his wife with his arms.
During Wednesday’s hearing, Arroyo spoke only to answer District Judge Joseph Patrick Kelly’s questions.
When asked if he planned to try to prove he was guilty of the lesser offense Arroyo said, “Yes sir, absolutely.”
Jury selection begins at 9:30 a.m. Monday.
