Grand jury rejects charges against family accused of attacking police

The family was out of control – brawling with police and shouting obscenities, according to police.

But Dalhia Villarreal remembers the night of April 11 differently. Villarreal said police bullied and beat her, her father, her brother, her nephew and a neighbor. All five were arrested.

“I hate that night,” she said recently, sobbing while sitting at her mother’s plastic-wrapped kitchen table.

A grand jury last week rejected the charges of assaulting a public servant police filed against the family, District Attorney Stephen Tyler said. The grand jury said a disorderly conduct charge might have merit, but recommended Tyler not prosecute.

Tyler hasn’t seen any charges against the officers, he said.

An internal investigation cleared the officers of wrongdoing, Chief Bruce Ure said.

The Advocate requested police records from the investigation on Thursday. The city attorney is reviewing the photos, videos and written reports before they are released to the public, Capt. Roy Boyd said.

The Advocate requested a use of force report in April, after the family complained about the police. The Attorney General’s office ruled in June the city must release the use of force report.

Police fill out the aptly named reports when they use force – for example, if they threaten to shoot a gun, stun a suspect with a Taser or hit a suspect with hands or an asp baton, Ure said.

What happened in April

Photos of smiling relatives beam from walls and cabinets in Juanita and Santos Cano’s home. They’ve owned the figurine-packed house at 3002 Callis St. house for 35 years, and raised five kids there.

Typically, their grown children visit often. Villarreal lives just blocks away and, until April, she said, dropped by her parents’ home all the time.

Her older brother, 44-year-old Victor Cano, and his girlfriend brought Juanita and Santos Cano dinner on April 11.

“We’re so close, he brings me leftovers,” Juanita Cano said, teasing her son.

After Victor Cano went to his parents’ house that night, three men jumped the fence and attacked him, then his parents, he said.

Victor Cano’s girlfriend, Irma Garcia, called police.

Juanita Cano called Villarreal, who rushed over in her nightgown.

When police arrived, everyone was upset, according to a narrative in the use of force report, written by officer Gary Melson.

“We calmed the situation and had (the fire department) make the scene to check on the assault victims,” he wrote. “The assault victims refused treatment and then began letting VPD officers know what had happened.”

Villarreal was hysterical by the time she got to her parents’ house.

Villarreal sobbed and yelled at her sister, 43-year-old Irma Huerta, both said. Now, Villarreal’s face becomes covered in tears when she says she has a big mouth.

That night, Villarreal said, she told her sister the police weren’t doing their jobs and cursed them.

In Melson’s account, he writes that Villarreal rushed at officers, screaming.

“She continued screaming profanity, which is normally found to be offensive and continued quickly approaching us,” he wrote. “This started getting the crowd worked up again and inciting an immediate breach of the peace. I confronted the female to try and separate her from the others in the crowd.”

When she wouldn’t calm down, Melson wrote, he tried to arrest her for disorderly conduct, language.

“He was just shoving my face in the fence,” Villarreal said. “I said, ‘You’re hurting me.’ He was just shoving me. He said it was my fault because I wouldn’t keep my mouth shut.”

Victor Cano heard the fray as paramedics inspected his face under flashlight, he said. He reached behind his back, waving to officers.

“I told the officers, ‘We’ll control her,’” Cano said. “Next thing you know, I’m on the ground.”

Victor Cano charged police, yelling at them and screaming, according to the use of force report.

“At that time I focused my attention on him and took him to the ground,” Melson wrote. “When he was taken to the ground he rolled on to his back and I was on top of him at about chest level with his arms still uncontrolled. Once on the ground he continued to resist my efforts to control him, refusing to go to his stomach, preventing me from getting him handcuffed.”

Victor Cano remembers getting hit once and falling to the ground. He put his hands behind his back and told officers to go ahead and cuff him, he said. Melson did, then he picked up Cano and threw him to the ground, Cano said.

“He kept hitting me,” Cano said.

Juanita Cano saw her son’s eyes roll back in his head when it hit the pavement, she said.

As Melson hit Victor Cano, his father said he expected other officers to help his son. They never did, Santos Cano said.

Even at 65, Santos Cano seems to pack more brawn than this 4 feet, 11 inch frame. He doesn’t deny his criminal record – which includes attempted murder charges from 1991.

Watching an officer straddle his son and swing away upset him, he said. He ran over to push 26-year-old Melson off, he said.

Santos Cano hit Melson, while Villarreal jumped on him, according to the use of force report.

“If I’d have kicked him, he’d have known it,” Santos Cano said.

Santos Cano remembers clubs “raining down on me.” Then, an officer stunned him with a Taser, according to both Santos Cano and police.

As the brawl continued, Morris Valentine, an 18-year-old neighbor, said he approached police. He tried to tell them to stop hitting the Canos, he said.

“I asked them to stop,” Valentine said. “I was trying to help them.”

Earlier, Valentine had seen three men attacking Victor Cano, so he hopped on his bike and followed the three as they ran.

As police tried to handcuff Victor Cano, Melson wrote, Valentine walked over and grabbed a hold of him. Valentine was in the way, although officers told him to back up, the report says.

Officer Stephen Lang stunned Valentine with a Taser three or four times – five seconds each jolt – Lang wrote in another section of the report.

Valentine, Villarreal, Victor and Santos Cano were arrested. So was Huerta’s 19-year-old son, Joe Huerta. Huerta was yelling profanities, according to the report, calling his outburst “an immediate breach of peace.”

Villarreal begged officers to let her change, she said. Her nightgown was soaked. She lowered her eyes and her voice as she described her condition.

“I was so scared, I peed myself,” she said. The embarrassment Villarreal felt before jailers let her change out of the sodden clothes still stings.

“I was really embarrassed,” said Villarreal. “Every time I see a cop, I get scared or cry.”

Her young son recently told her he didn’t like police because they hurt his grandfather and uncle.

“We don’t teach them that,” Juanita Cano said. “They’re supposed to be there to protect them.”

Villarreal has never been arrested before, she said. District court records show no criminal charges against her. Her brother went to prison after pleading guilty to criminal mischief, according to records. Records show Santos Cano unlawfully carried a firearm after he was convicted of attempted murder.

“This is not the first time I’ve been in trouble,” Santos Cano said. But he’s never hit a cop and he’s never lied, he said.

Police damaged his family on April 11, Cano said, comforting his daughter as she sobbed at the memories. Villarreal, 36, won’t return to school because she’s ashamed of the fracas, she said.

Victor Cano’s neck aches – an MRI shows his vertebrae are damaged. Santos Cano’s shoulder was injured, he said.

“They messed up my brain,” Santos Cano said. “Because I’m always thinking about this.”

  • OMG I just read this story and it sounds like typical  "familia" B.S. if you ask me. How many times has anyone gone to a family gathering and had some B.S. go on there, then once the cops responded instead of the person they wanted getting into trouble someone else did how sadly they cried about how they were mistreated.  I once went on a ridealong with VPD and remember going to a call where a woman was being abused by her husband and once we got there he was gone, the officer checked her home to make sure he was gone and the lady said if he came back she would call again, we rode around the neighborhood thinking that he might still be in the area and saw a car pull up to this ladies house so we went back thinking that it was her husband back to hurt her, but no it was her son and daughter(of course we did not know this when we pulled up).  Upon getting out of the patrol car the woman became irate with the officer and started to throw her arms yelling that nothing was done blah blah blah, then when her son tried to calm her down and get her inside the house she began pushing on him and started talking mad mess to the officer who had turned back around to make sure that this lady was ok!  By this time there were about 2 other units there and the lady was still talking smack when the officers were trying to get information from the others who were there to see if they had any information that could help in finding this womans husband whom she claimed abused her.  The lady began to threaten the officers and was arrested for public intoxication once she set foot on the street.  I could not believe the way this woman was acting, I mean here are people who came to her aid, she called them and once the put the handcuffs on her she tried to bit them, head-butt them and everything else.  When they finally got her in the car she kicked out the window and continued yelling obsceneties! Now not everyone has a perfect life or family but if you screwed up, fess up to it and stop trying to place blame elsewhere. Cry me a river for the family that thought they were billy bad a** and ended up getting into more trouble than they thought. Kudos to the officers.

It has not been often, as a matter of fact, never, that three people have jumped my fence and attacked me. Could this Wilbur person have been more complete and elaborated on this fact a bit more? Laziness on her part? I'd be willing to bet that attack was an instigation of this dysfunctional family...

  • Dang it, I always miss the good posts. I just finally got caught up and have to say I'm sorry I missed the fun. Hey bigmommas house, what gives? And no I actually don't watch cops and as a matter of fact I said "reality police shows" which yes includes cops and other shows. My guess is this, you guys called the police, police didn't believe your story or ya'll were too busy acting like animals it never got that far. One person cussed, which by the way the Supreme Court says profanity is not protected in the 1st Amendment. Your family gets arrested so you guys now do a 360 and get mad at the cops. Your true sides come out and boom, you all go to jail. And something about the dad being that age and according to the article, of small stature making the comment about "If I kicked him he would know it" is ridiculous. I doubt the cops were scared of him no more then me being frightened of a rabid ankle biting dog nipping at my shoelaces. And tstorm and southtexas, its nice to be on the 'same side' for once. That's in any situation!  I keep hearing the video about the dad saying they were beating him my son, than he says they were killing him so which was what? I know all the parties in the family and as long as you dont know what is going on I think the girl Savannah has a right to express her feelings on the matter since she went threw life putting up with these people she has a right to say what she feels so as for them being proud of her they dont need to be proud of her she has alot of people that are very proud of her because she has done very good in life and it was not thanks to any of the cano's. She will be a someone in life she is in all GT classes she is always helping people and is there for everyone and never puts anyone down for her to have said what she did it came from her heart because she does not put anyone down so yall to people need to shut the hell up and worry about keeping on playing the games yall are playing back and forth on this site.

  • Why was nothing heard from the Cano's on April 12th or April 13, or April 14? I would think if they felt wronged they would have been crying to the Advocate sooner than they did.Certainly looks like they have lawyered up and have been advised to go public before they file charges or sue.Victor Cano's burn marks in the photos actually look like fire ant bites that he scratched too hard, not taser wounds.

  • The case was probably dismissed because it was more trouble than it was worth.....Can you imagine this whole family in court???? Close your eyes....create a mental picture.

    No one was actually seriously harmed. If you had a trial or a hearing involving these people you would have to have extra security....there would probably be several more fights, wailing and thrashing and pounding of chests; the cost would be substantial. Then you would have to arrest the family members that charged cursing the judge or kicked the baliff....Just let sleeping Tazmanian Devils lie.

  • ALS: I read the paper. Doesn't change my perspective. I believe I stated that they deemed there wasn't a case to pursue so we have to assume justice was served. Considering the events of the recent past that I've been involved in and that I'm pretty sure most of those in here are aware of, my vocalizing my suspicions about why the PD's case wasn't accepted by the GJ would likely come across as so much sour grapes.

    Besides, I figure most of those intelligent enough to make that connection probably already have.

  • Ernie and all the other posters defending the PD's actions, please reread the article. The case presented to the Grand Jury was NOT against the police, it was against the family.

    It reads "A grand jury last week rejected the charges of assaulting a public servant police filed against the family, District Attorney Stephen Tyler said. The grand jury said a disorderly conduct charge might have merit, but recommended Tyler not prosecute."

    Obvioulsy, after hearing evidence and testimony from the PD the Grand Jury didn't think there was enough to indict any family member of assault on a peace officer. The PD was the one crying "foul", so I have to wonder what is the real story?

    Also, the PD has been quick to release any and all things when it comes to their complaints against Tyler. Why is it that now they choose to not be so cooperative with the media? Ummmmmmm?????

  • Well BigMomma, first of all, cops are not "put into office" as you state. They are hired on to do their job just like everyone else. It's not an elected position. And I agree with Willie, I have a very hard time believing you are in law enforcement. They can usually spell and speak with a clear train of thought and I have seen neither of those come from you as of yet.

  • Now that having been said....

    I don't know this family and I wasn't there to witness the incident. That being the case, I have to assume the GJ heard enough of the evidence to determine there wasn't a case against the PD to pursue and that, therefore, justice was served in the matter.

    Normally my tendency is to favor the PD and in this case I see no reason to stray from that inclination. I'm a little dismayed though to see so much and so strident emotion being tossed out with so little to base it on! Geeez, I really hope I don't get on the wrong side of some of you!

    Ok, so Papa probably can't legally own a gun to protect himself with but as far as I'm aware, there's no law against him having a baseball bat. After all, the police do what they can to be proactive and prevent crime but they can't be everywhere all the time and the normal course of events is to be called during or after an event so 90% of the time their job is unfortunately REactive. Even if the "perps" are done and gone when they do get there they have to attempt to sort things out. As TStorm said, if they just drove away they'd be catching all billyhell for NOT doin their job.

    And you have to remember too, these officers are arriving on a scene that, based on what little info they have, is already violent. Almost certainly they've not been faxed photos of the alleged victims on their drive over so they have no clue who are the attackers and who are the attackees.

    Yelling, cursing and hitting the officers while berating them for not doing their job no sooner than they get out of the car is probably not the best way to ID yourself as the victim.... The officers' first duty is to secure the scene, protect the public and then to protect themselves. Sounds to me as though, in this case they had to secure the public just to protect themselves!

    Once again, when the man with the badge and the gun says to sit down and shut up, one would be well advised to do just that.

    Oh please, give me a break. The Victoria Advocate does it again. We are supposed to feel sympathy for these poor people sitting at their plastic wrapped kitchen table with smiling photos of family around them.....My God it is almost like the Cleavers home.

    The police could not walk off as some of the other posters have suggested. They may not like it but they have a duty to investigate the three unknown assailants that they were called there to protect this family from.

    What do they get.....they get attacked. And there is no other way to put it. Running at and cursing the police that have come to help you is hardly the way to show appreciation or cooperation.

    My guess is that that was the case before April 11th....only because of fear that the cops might be there to arrest someone for past crimes.

And the poor lady who said she cries when she see's the police, gimme a freakin break. You want some cheese with that whine? Get some education and quit blaming everyone for YOUR mistakes.   • On the other hand--- The police were called to a scene for a legitimate reason. When they arrived, there was no sign of the assailants. They could have just said "It's all over, folks. We'll keep an eye on the place. Good night." Instead, the police reacted to comments made about them by the residents. Telling a cop that you don't think he is doing his job, or whatever, is not a crime. Or shouldn't be. The police could have walked away from the Canos with no more damage than a few curse words ringing in their ears.

If they had acted like humans instead of wild animals, the police would not have had to subdue them! Now they want to cry about the treatment they received? Bull!!!     So, the police respond to a 911 call about possible assault. They get there, the owner of the house happens to be a person with a history of violence... people are yelling, screaming, cursing.... the police tell them to calm down and they don't.... One person gets handcuffed and her brother, who is being examined by a paramedic, starts making a move behind his back.... well, what the hell do you think is gonna happen????

    You know, this family has reason to feel embarassed.... they embarassed theirselves!

    Quit whinning, learn your lesson, and act right.... don't expect the people of Victoria to feel sorry for you because you acted like a bunch of outlaws!

  • These people want $$$$. They figure with all the other goings on (i.e. Ratcliff, the indictment's, etc.) this is a chance for their "story" to be heard. I bet the old man cried and whined when he was turned down for a job because of his past attempted murder. Just like in this case, its not ever his or his families fault. It's always the fault of others. Way to go VA, you gave them what they wanted, their 15 minutes of fame.

  • Does anybody really belive the Cano's story? I hope there isn't anybody out there that feels sorry for them. When the cops arrive at your house to save your behind, shut up, keep your hands to yourself, and let them do their job!! It is hard for me to belive a convicted attempted murder suspect when he says he did nothing wrong. maybe your kids were living by your example. If you hadn't tried to kill someone years ago, maybe this wouldn't have been an issue now. Its your lifestyle that caused this to happen Mr. Cano,change it and maybe things like this won't happen if you do. What happened on April 11? The brave men and women of VPD put their life on the line to help some idiots and did their job, that's what happened.

Every single one of them are violent and if they don't get their way they throw themself to the ground kicking and screaming until someone says "Okay you win..Get up Now!" I can not believe the Advocate even cared to listen to their story. Why did the mother call her daughter in the first place? Why not just call 911 and ask for help? That is the normal thing to do. By callin her daughter that just escalated the entire situation. They are all so full of BS it makes me sick!
