Perhaps readers have followed the fate of ex-Border Patrol agents Ignacio Ramos and Jose Compean. Both men are serving 10-year sentences for shooting a fleeing illegal immigrant, Osvaldo Aldrete-Davila, in the buttocks while smuggling drugs across the Texas border. By the way, Aldrete-Davila will be sentenced next month on a separate drug-smuggling offense which occurred while on a humanitarian pass to enter and exit the United States unsupervised while he was under an immunity agreement to be the lead witness for U.S. Attorney Johnny Sutton against the two border agents.
Most disturbing about this case is the law the agents were prosecuted under (924c law). The law is supposed to apply to a criminal who chooses to use a weapon during a crime, not law enforcement agents who have to use their weapons to do their jobs. Congressman Kevin Brady (R-Texas) has proposed a law prohibiting the use of 924c against law enforcement officers, but, if passed, would not be retroactive and would have no effect on the Ramos and Compean case.
More than 100 members of Congress from both parties have asked President Bush to either pardon the agents or commute their sentences. Rep. William Delahunt, who conducted a subcommittee hearing investigating the case last year, wrote letters to Bush asking for a commutation of sentence. The U.S. 5th Circuit Court of Appeals has ruled the law was misapplied, yet the agents are still in jail.
I continue to follow the case hoping to hear of a pardon or that the court appeal has been granted. In the meantime, I have sent words of encouragement to both Ignacio and Jose. The wives of both these men have indicated that the flurry of mail their husbands are receiving is lifting their spirits tremendously. Contact information:

The time should match the crime. This sentence doesn't. Still believe the agents were acting in best way they knew to stop a smuggler, and I certainly don't believe the drug smuggler was honest in his testimony. He got another chance to dump drugs on the streets of Texas, but was caught. Many members of Congress agree. The agents have done enought time. Letter from Congress:

We write this letter asking for your personal intervention to use your exclusive authority given to you under Article II, Section 2 of the Constitution and pardon U.S. Border Patrol agents Jose Compean and Ignacio Ramos.
As you know, these two agents were prosecuted and convicted for shooting an illegal alien drug smuggler near the U.S. Mexico border in Texas and were sentenced to over ten years in prison. They have been imprisoned now for almost two years.
Yesterday, the United States Court of Appeals for the Fifth Circuit rendered its decision on the two agents appeals and upheld the most serious yet the most unjustified charge; one that carries a mandatory 10 year minimum sentence for the use of a firearm. Clearly, we feel the law was misapplied and law enforcement officers who are on duty and during the pursuit or apprehension of an individual who they believed had committed a crime should be an exception. The severity of the charges and the harshness of the punishment is totally disproportionate to the violation in question.
Further, this decision and the national attention given this case has had a demoralizing effect on the men and women who defend America at our border while at the same time sends the right message to the criminals seeking to do our nation harm. Our border agents must not have hesitation before using their weapons in defense of our laws and borders from dangerous criminals. The results of this incident are unfortunate yet the unintended consequences stemming from it are far reaching and one that warrants your immediate intervention to restore safety and security at the border.
We therefore again and respectfully ask, especially as you near the end of your administration, to correct this injustice that has occurred during your presidency and pardon U.S. Border Patrol agents Jose Compean and Ignacio Ramos.

Anyway these agents were convicted because of the agents' own conflicting stories and actions ---- and the statements of other Border Patrol officers who testified against them, including the five agents and two supervisors who showed up on the scene.

I have, and they deserve the punishment they are recieving. And I'm no liberal weakling. All law enforcement officials take an oath to protect and enforce the law. Do break the law while pretending to enforce the law should be dealt with severely.

July 31, 2008 at 4:08 p.m.Roberttx-To answer your question-no. Counts 6 thru 10 of the indictment which dealt with obstruction of justice were reversed by the 5th Circuit. Prosection and conviction under 924(c) carried a mimimum 10 year sentence. The ruling also stated that they could surely debate whether there is an intuitive distinction between a violent criminal or drug trafficker using a gun during the course of their trade and a law enforcement officer using a gun against a fleeing felon; however, neither the statute nor the case make such a distinction. Thus the bill introduced by Rep. Kevin Brady exempting law enforcement officials from 924(c).

This guy was a coyote with a sealed record. He is a serial criminal. The judge would not let all the information and facts be revealed at the trial.
Bush and the federal level are behind this. Johnny Sutton was mad they would not take the 2 year deal. So he made sure he pi###d up the wall higher.
Ask yourself after these last rulings, if the law enforcement officers will protect you.
As hiding evidence or such. It was because they did not tell their immediate watch commander something. Which by their policy they were not required to. This was another Johnny Sutton Kool-Aid trick.
Ask your self why the Fifth Circuit poured acid over Johnny Sutton last December and then made a Bush Kool-Aid decision yesterday?

Further, there should be a full-scale investigation (either legal or journalistic or both) into the driving force of this aggressive prosecution against two law enforcement officers doing their jobs and the leniency toward the illegal alien who was further violating U.S. law by smuggling drugs into the country. In other words, who was Aldrete-Davila REALLY working for?
