Man gets two 35-year sentences for police attack conviction

A 29-year-old man who threatened police with a gun will spend 35 years in prison, a judge decided Monday.

A jury found Thomas Marcus Mistrot guilty on May 9 of leading officers on a chase that ended with Mistrot pointing a loaded Colt .22 at two police officers.

Victoria County District Judge Robert C. Cheshire announced Mistrot’s sentence Monday afternoon. Mistrot will serve two concurrent 35-year sentences for aggravated assault against a public servant. Cheshire also sentenced him to 10 years in prison for felon in possession of a firearm, two years for evading arrest and one year for deadly conduct.

After hearing the sentence, Mistrot asked Cheshire to clarify the aggravated assault charges.

“Is that saying I wanted to cause the person harm?” Mistrot asked. Testimony about Mistrot’s low IQ and emotional troubles made up most of his defense during the sentencing.

“That’s what the jury found you guilty of,” Cheshire said.

District Attorney Stephen Tyler had asked Cheshire for life in prison, the maximum sentence.
