Yorktown man charged with photographing bikini-clad young girls at Cuero pool
A 55-year-old Yorktown man was arrested Saturday at the Cuero City Pool, above, and charged with improper photography, a state-jail felony, for reportedly taking pictures of underage girls.

(1) Photographs or by videotape or other electronic means visually records another:
(A) Without the other person's consent; and
(B) With intent to arouse or gratify the sexual desire of any person; or
(2) Knowing the character and content of the photograph or recording, promotes a photograph or visual recording described by Subdivision (1).
(C) An offense under this section is a state jail felony.
CUERO - A 55-year-old Yorktown man was charged Friday with improper photography for taking pictures of underage girls at the Cuero swimming pool.
Felix Arguellez, a Yorktown business owner, was arrested about 6:45 p.m. Friday after Cuero police received a call of a suspicious person taking photographs at the pool in the Cuero city park.
Cuero Police Lt. Stephen Ellis said officers located Arguellez in his vehicle at the park. Photographs on a camera showed some close-ups of young girls in bikinis.
"They weren't your typical tourist shots," Ellis said. "They weren't just wide shots of the pool or the park."
Further investigation also revealed at least one printed photograph that had been blown up to 8 x 10 size of a young girl in a bikini. Some of the girls photographed were as young as 11, Ellis said.
"Our officers checked with the district attorney before finalizing the charge," Ellis said. DeWitt County Justice of the Peace Bill Robinson approved the arrest based on probable cause.
"It's about the nature of what the pictures are being used for," Robinson said on Monday. "That's got a lot to do with it."
Arguellez declined to comment Monday when contacted.
He was released from the DeWitt County Jail after posting $30,000 bail.

It's funny how parents send their daughters into public wearing underwear, euphemistically refer to it as a bathing suit, then stand there with mouths agape when cause-and-effect occurs. The photographer's a pervert, yes. But the parents are undiscerning and woefully naive. It's a mad culture, that's for sure.
August 15, 2009 at 1:11 a.m.BUT no one was kidnapped, murdered, or raped and everyone is totally overreacting. Has no one ever heard of a little term called reasonable expectation of privacy? These people at a PUBLIC swimming pool did not have a reasonable expectation of privacy. I am starting to agree with my husband: I thank God I am not a man in today's society, where it's almost to the point simply looking at a woman or child can get you imprisoned. I, too am left to wonder where the line ends between creepy behavior and criminal behavior.
August 10, 2009 at 7:05 p.m.Mattfeley- It is a race/ethnic (depending on how you look at it) and was not a label. Even if it did not say he was hispanic I would have assumed because of his last name. It was not an insult unless you make it that way. If his name was Fitzgeralds I would think Irish. Wouldn't bother me and I am Irish. I am proud to be. I would be more appaulled at someone disgracing my heritage with such an act rather than be upset with someone who stated fact.

Creepy behavior is this old man taking pics of 19 yr old girls.....criminal behavior is this old man taking pictures of 11 yr old girls. If he did do what he is accused of, it is a crime/criminal behavior. Do you think he should have to actually have physical involvement with these kids for it to be a crime? Do you think this man has the right to take photos that focus on "certain parts", or any part for that matter, of someone elses child? Do you know what his intent is with these pics, are they just for his pleasure, is he planning on selling/sharing them with his buddies, is he planning on posting them online? Regardless, if he did what he is accused of, he has some issues that are best handled with him off the streets.

August 4, 2009 at 7:07 p.m.I've kept my mouth shut on this one, but when people start blaming the children who were swimming at the pool for their pictures being snapped, I had to open it. When I go swimming, I wear a bathing suit, not a burka, or pants & a sweater or a prairie dress. When my child goes swimming, she too wears a bathing suit. That does not give anyone the green light to take pictures of or approach her inappropriately. If these were adults being photographed, most likely I wouldn't care...they are adults, they can take care of themselves. Blaming these kids for this mans behavior is akin to blaming the rape victim for her attire. I guess you people would be happier with this arrest had he actually taken his behavior a step further & ruined some kids life. Kids need to be able to be kids. They should be able to go swimming, play in their yard, ride their bikes, etc without having to worry about being kidnapped, raped, murdered. It is very sad that people would openly defend this mans behavior instead of defending the kids right to have fun & be safe at a public swimming pool.

I can't remember what the second offense for sending nude pics was, but it sounded minor when I heard it. Now if sending nude pics is worth a $15 fine, why is this guy in jail for taking pictures of people in public at the community swimming pool?

I would not allow my child to wear a bikini at 11 nor would I leave them alone at a public swimming pool. Where was the life guard? Where were the parents? How come someone didn't see him taking pictures?
WATCH THIS GUY SAY he's an architect who was taking pictures of the pool layout and the girls got in the way every time he took a picture!

My first thought was, why were the parents allowing their young daughters to were bikini's anyway? We really need to be more careful about what is worn in public. These girls were out there for everyone to see. I'm not saying that the man was right to be photographing them, but why weren't they dressed more modestly to start with??

A 55 year old hispanic man should not have pictures of young girls. It said he had an 8x10 of a young lady? Thats nasty. Besides if you want to call him or yourself a "photographer" then be professional and get permission forms signed. Go through the proper channels and you won't cause suspicion.

August 3, 2009 at 10:29 p.m.I have mixed feeling about this event. I do not know Felix Arguellez and I have not seen any of the photos. Without any prior knowledge it is difficult to judge this event as a leach or an amatuer photograher not being very smart. I do feel that Mr. Feliz Arguellez should have sought out permission to take the pictures if they were to be used for possible publishing or as part of an amatuer photography hobby. When I lived in Calif., people took pictures of individuals on the beach all the time, many were seeking models for teenage magazines, other were members of local amatuer photography clubs, and then there are just tourist. It is often difficult to written releases for everyone photographed, especially if they are in a crowd or moving. I doubt even news networks get permission of everyone in photos taken during spring breaks, concerts, pool parties, and etc. And I believe almost everyone female and male both have been fooled more than once that a young female was years younger than she appeared to be. I am aware of Christopher Cushak and Yordonka Windlinger's works of photography that have are not been accepted in the United States.
