CUERO MAYOR TAX WOES -2009-12-10 00:09:00

CUERO - Mayor Randy Saenz paid Wednesday more than $18,000 in unpaid 2008 property taxes, fees and penalties after DeWitt County filed a lawsuit to collect the delinquent payments.

Saenz, who served on the city council since 2000 and is in his first term as Cuero mayor, owed the taxes on his home and a daycare business.

After being notified of the lawsuit Wednesday afternoon, Saenz paid the amount owed in full.

The county will now drop the lawsuit, Susie Dreyer, DeWitt County tax assessor-collector, said.

"This has been the toughest year of my life," the 36-year-old mayor said. He pointed to the February death of his father, a man he called his best friend. Then, Saenz comforted his disabled mother and nurtured his wife's illness, he said.

"We had another baby in July. I have nine children and five businesses," he said. "It just consumed all my time. I dropped the ball on paying the taxes, but they are paid in full now."

The original tax levy on Saenz's home was about $6,400 but with penalties, interest and attorney's fees, totaled about $9,600. For the daycare, the original levy was about $5,900 and about $8,800 was owed.

The taxes were due Jan. 1, 2009, and went delinquent Feb. 1.

The mayor was one of about 21 DeWitt County residents who were or will be served with tax lawsuits. Three of the 21 delinquent tax bills were at or near $20,000, said Dreyer.

"Some of the 2008 taxes past due are such a large amount we had to file," she said. "He's not the only one unfortunately. The economy is affecting a lot of people."

Dreyer said tough economic times impact overall tax collections. The county normally collects between 97 and 98 percent of taxes.

"We were down a fraction of point this year," she said. "I expect that trend to continue."

The county sent a letter to the 21 taxpayers about a month ago advising them of its intentions to sue for the unpaid taxes.

"We offer them the option to come in and sign a contract and work out a payment plan," Dreyer said.

When residents pay delinquent taxes, fees and penalties, the county notifies its delinquent tax law firm. Linebarger Goggin Blair and Sampson of Austin then drops the suits.

Cuero's mayor said he knows that as an elected official, he remains open to scrutiny.

"If people want to take comfort in my misfortune, I guess I'll be the sacrificial lamb," he said. "But I am proud to be the mayor of Cuero despite some downfalls in my personal life."

  • Again my point that I said earlier in post at beginning...Why weren't the other 21 people who owed taxes faces plastered across paper, heck names would have been just fine...Randy is not a bum...He was smart in school, had his head on straight and when he started his businesses he started smart..He continued to build them with his own money and time..I wonder how many of these people on here that are posting are from Cuero...Jealousy is a bad thing..and this is what it is leading up too...He is young and has so much to offer...He tries to make things happen for kids in this town...When not in office you will find him at other businesses then at home spending much needed time with family...Something alot of us wouldn't feel we could handle or have time to do just working 8-5..Randy you an awesome guy and mayor..Good morals..You continue to do the work you are doing in this town as Mayor and as the person you are..

  • To all of you throwing down rumors and hear say.....let's see your proof. Have you been with Mr. Saenz every moment of the day to know who he has been with or where he goes? Don't think so. I'm not saying he has or has not done anything wrong, but really people, GET A LIFE! But then again, I just drove by his newest business tonight and his restaurant was packed. So maybe the negative publicity was good for him.

And another thing, it's a funny thing the Victoria Advocate could not publish the other 20 names of deliquent tax payers (you might be surprised!!). I have a question for the Advocate.....are you so desperate for news worthy stories you have to call all the local tax departments for the latest scoops? Or is there a snitch in our fine DeWitt County offices? Can anyone answer this one?

  • If he paid his taxes on all his other properties how did he forget to pay for the others? Why do we assume he paid the taxes out of his pocket book? He might have had to borrow the money. What businesses does he own? Are they legitimate?

  • MrsMack well put..Now I see how rumors get started..He stated about the children then tried to justify "Oh must have just been rumor." Hum if you don't know facts then don't spread anymore..Yes everyone is human...I stand by our Mayor..He is doing wonderful work here in our small town..

  • Interestedreader:just couldn't help myself to add on to your comment...I appreciate the fact that you admitted you heard rumors which was the point I was trying to make. so many of these people are posting off of what they've heard only. I think it's great that he put something to comment why he hadn't paid. Many people don't and they would have just been left wondering and starting up a bunch of other unneccessary rumors. I know of the family well as Cuero is a small town but what they all fail to know is that the man and his family own 17 properties 15 of which he paid taxes on. All of it is public record and you can look it up yourself. He also pays corporate taxes, franchise taxes, sales taxes, twc taxes, 940 and 941 taxes plus any other taxes related to owning companies. I commend him for trying to make a better life for his children and having 5 businesses in which he can afford to just cut a check for the 18k. Not many of us can but due to his unfortunate circumstances this year so he failed to pay 2 out of 17 property taxes...i think we've all had something similiar happen when we had a situtation going on in our lives like not paying certain bills on time due to being out of town for a funeral or such. Maybe if everyone posting negative comments would go out and do something like work 5 jobs like his family has established then they would totally understand how something like this can happen to such a hard working man. I've been at the council meetings too and I know for a fact that this man does not allow his family business to partake in his running the city so that too is beyond rediculous that anyone can even suggest this. When he is running the city thats exactly what he is doing. When he is running his businesses he leaves the city council out of it. If people took the time to stop being so envious and really got to know him they would really admire the man not only for his efforts in trying to better the city, but also in his efforts of being such a true honest hard working man. Go out and get yourself 5 jobs and see if you can be perfect...I sure would like to see that.

  • "Interestedreader "How sad that you thrive on bad speaking about others. It is very evident you and others here are so envious and jealous. Those who anger you control you....How unfortunate that you have to let someone elses problem become yours and anger you so much that you have to speak badly and lies on top of that. Everyone of his children attend Cuero Public schools and he didn't need help from the government to have his children. Get your facts straight before you start letting your anger be controlled by others. You act as though none of you have ever made a mistake before, hmmmmmm I wonder how many of you have.........Take a deep breath and sigh, tomorrow will be a better day for you." Seems funny though that he can control you simply by angering you. " You can tell just by seeing the same person posting, they don't have nothing else better to do..

  • I live outside the city limits of Cuero and cannot vote for City government positions, but remember who voted for this person.....the people who live inside Cuero city limits! If you don't like what he has done, then don't support him in another election. But good luck in finding someone whom you think is "honest & dependable" to run for Mayor, or any other public office around here.

No wonder you hear about some towns electing a goat or dog to run their town!

Welcome to small town America folks!

  • How can someone own 5 bussinesses, have that many children, an ill wife and still properly represent an entire town? Why is it not a requirement that to be an official elected by the people for the people that you must be in good standing with all entities city, county, state, etc.? I believe he had his little fun of showing that he could be an "important person" but it is time for him to step away.

    December 10, 2009 at 8:30 a.m.
  • Ok they pointed out that over 20 others owed Taxes..Why plaster his all over paper cause he is Mayor..Give me a break he is human just like everyone else..I swear, some people just don't know how to let anyone have privacy...Tomorrow I want to see the other tax payers pictures plastered on paper..Cause for a fact I know some of them owe lot more than what mayor owed..

  • Mmm, he is more than qualified to be Secretary of something for the president's cabinet. There is no way a person can overlook 12K in taxes. This is a total disgrace, but I do applaud this person for having the cojones to call himself a sacrificial lamb, please.. you are an embarrassment to not only the Latino community, heck, you are an embarrassment to all the law abiding citizens. You should take your cabro arse out of the office that you are currently occupying if you have any decency, oops, politician, I guess that you are staying. Just in case you need a reminder, tax season is upon us again, in about 3 weeks.

  • Poor, poor Mr. Saenz…..The only human being on planet earth that is having a hard time.

"If people want to take comfort in my misfortune, I guess I'll be the sacrificial lamb," he said. "But I am proud to be the mayor of Cuero despite some downfalls in my personal life." - Saenz

    Misfortune???

I pass along my condolences for the death of his father, but death is natural and everyone is forced to deal with it.

How misfortunate to own five business, and be blessed by God with nine children, and reside as mayor of Cuero.

The misfortunate Mr. Saenz cut a check for the full $18K. Seems to me that if he were so misfortunate he might opt of a payment plan.

To achieve all that Mr. Saenz has, one needs to be competent and a planner. I doubt the fact the he owed $18K in taxes just slipped his mind.

I try not to make assumptions, but is it feasible that maybe, possibly, perhaps, conceivably, Mr. Saenz, first term mayor, thought if he didn’t pay the taxes his mayoral standing might entitle him to special treatment???

Thanks to the county for holding this “sacrificial lamb” accountable.
