Fatal wreck trial begins

Testimony began Tuesday in the intoxication manslaughter trial of Bryan K. Brown.

Brown, 41, of Victoria, is charged with being intoxicated and causing a June 7, 2007 wreck that killed Vanessa Jasso, 24, and Rudy Flores, 52, who was riding with Jasso; and injuring Jasso's son, Jacob Amezquita, 6. The wreck occurred at the intersection of North Delmar Drive and the Lone Tree Road.

Brown's lawyer, George Filley III, questioned Officer John Turner if Brown was under arrest when a blood sample was taken from him at Citizens Medical Center.

A paper signed by Brown said the blood sample was taken after he was arrested and refused to submit to testing. But Brown was not arrested when the blood was drawn, Turner said.

Prosecutor Eli Garza asked Turner to clarify if the wrong forms had been used and why.

"He did not refuse," Turner said, adding the form Brown signed was the paperwork they had.

Testimony continues at 1 p.m. Wednesday in Judge Robert Cheshire's courtroom.

  • Vanessa was a young single parent that worked very hard to support her young son....she did NOT deserve to die because of this guy's stupidity..........I also hope that justice is served......hopefully the "system" will do for her what they NEVER did for other people in Victoria who died in vain without an investigation and the responsible party or parties were let go without a "fight" or anything!!!!!!! I pray that that doesnt happen in this case......RIP Vanessa....

  • I would hate it if, for any reason whatsoever, this man was found not guilty. Regardless of the quality of the police investigation, regardless of what some people may think about VPD or the DA, because of this man's very, VERY stupid decision to drive a vehicle after consuming alcohol, a young boy was left severely injured and was orphaned. This man deserves to be held accountable for his stupidity and I am hoping he isn't acquitted.

  • IF....I repeat IF...this man is found not guilty because Mr. Filley is able to create reasonable doubt about the quality of the police investigation, then maybe people might understand the DA's frustration with the PD, his requiring of the affadavits, and his refusal to accept some cases because of faulty police work. 
    I agree that Mr. Filley is a very good lawyer...but we need to have confidence that our police do their job correctly and completely so that defense lawyers can't use their work against them.  I'm sure every member of the VPD wants a conviction in this case as well and doesn't want a possible "not guilty" laid at their feet.
    It will be interesting to see what future Advocate reports have to say about the case. My hope is that the man is convicted and punished for ruining this family.

  • darlins - You are exactly right. He will get this man a not guilty verdict IMO. George is an awesome lawyer and knows how to work the angles. I know I would want him by my side if I had to go to court.

  • Mr. Filley's defense of Mr. Brown is what he is getting paid to do. I'm not saying it is true in this case, but in some cases, a defense lawyer knows that their client is as guilty as sin, but they are paid to "defend" them, so they do to the best of their ability.

    I'll also add, that there is a minute possibilty that with the recent controversary surrounding VPD that Mr. Filley is creating "reasonable" doubt. If he can get the jury to focus on the negative, can he discredit the police investigation and get this man off scott-free? I hope I am wrong.

  • I agree with you SouthTexasGuy, but the bottom line unfortunately is that a family got destroyed that day. If anyone remembers,this guy tried running from the police right after the accident on top of all that. Sometimes I wonder if their own defense attorneys can live with themselves for defending scumbags like Brown.

  • Let's hope that having the defendant sign a VPD-supplied form that was erroneous in content will not be a significant factor in this trial.
