YOAKUM - One man charged with capital murder is pointing the finger at 20-year-old Jordan Cole Hessler as the one who pulled the trigger in the shooting death of a 70-year-old man.
Hessler of Yoakum turned himself into police late Saturday afternoon and was charged with capital murder, police said Monday. He joins two other men and a 16-year-old, all of Yoakum, who were charged in the Sept. 27 slaying of Teodoro Cervantes of Yoakum.
According to the arrest warrant, Jacob Paul Reynosa told Yoakum police that Hessler "cycled two live shotgun round through the pump shotgun and fired a single shot through the bedroom door" of the home in the 100 block of Hubbard Street.
The shot also wounded Jose Cervantes, the victim's grandson.
Reynosa, 19, Hugo Adrian Ibarra, 18, and a 16-year-old boy were arrested Friday. A fifth person, known to Reynosa only as Tada, also is being sought, said Yoakum Police Chief Arthur Rogers.
Reynosa, according to the affidavit, said he and "four others . entered a home armed with a Remington pump 12-gauge shotgun and a .22 caliber pistol . with the intent to commit a burglary."
They believed the home to be unoccupied, Reynosa stated in the affidavit.
Reynosa also led Yoakum police to the shotgun, recovered in a creek off Lavaca County 400, Rogers said.
Lavaca County Justice of the Peace Alene Lyons set the bond on each man at $1 million. They remain in Lavaca County jail. The 16-year-old boy is in the Victoria County Juvenile Detention Center.
Reynosa, in the affidavit, said that Hessler also "punched Jose Cervantes in the face and took some money from him." About $90 was reported to be taken from the grandson, who fled to his grandfather's room after breaking free from Hessler and Ibarra, according to the affidavit.

i give my condolences to the cervantes family and as for the losers who were involved in this bull**** what were you thinkin ya'll know that is not how yoakum people do it get a JOB and for the family of the criminals i should say it may not be entirely your fault but i do know some of you and you weren't exactly the best role models and i know that for a fact i was at or around you basicaclly everyday and i saw what a bad influence you had so don't get mad you are getting the a** end of things look back on how you were.i think they should get severly punished and not a slap on the wrist make an example out of them so no one else will be stupid enough to do the same thing....

October 6, 2009 at 9:29 a.m.For the family, you have my greatest sympathy. This was so senseless. I say FRY THEM ALL! What gives these punks the right to go into anyone's home? So what if they thought it was unoccupied? They still killed an innocent man, and why do people what to say an "old Man'? He was not old, and from the picture they posted of him, he looked very healthily and strong. But, it does not matter his age, he was a human being, and did not deserve to die that way. This is what the world has come to; the young punks think they can take over. And, where the heck are their parents? They just do not care and are allowing these punks to run the streets and do these horrible things. Then the parents of these punks want to cry and beg for mercy for their kids. What about the wonderful family man they killed, did they listen to him beg for mercy? Why don't these kind of punks just use each for target pratice, and not go around killing innocent people? October 6, 2009 at 9:25 a.m.My boyfriend knew Mr. Cervantes personally. He was my boyfriend's Godfather. My boyfriend went to the services that were held and told me that the family is in a lot of pain. I believe that if they were there, pointed the gun, loaded the gun, or shot the gun, they all knew that they were going into a home armed. They should all get the highest punishment possible. The pain that they left the family, is devestating. This man, from what my boyfriend counts, was a hard working, strong individual that believed in family values. My boyfriend can't read the articles, since they are in English, but I can, I read them to him and watch the anger in his eyes. But we both believe strongly in God and know that He will bring justice to this. The loss of Mr Cervantes touched a lot of people. It will be a long process to get the justice, but i'm confident that these men will pay for there wrong doing.

These criminals should have the maximum charges filed against them, and the District Attorney (who is elected by the people) should prosecute to the full extent of the law.

October 6, 2009 at 1:22 a.m.Yes as much as I would like for these society rejects to go to prison, I am certain that they will shout and berate, that they killed an old man and that is why they are in jail. They are what they presume tough guys, then what? Will they get out and continue their filthy ways trying to recruit other lost kids. I would like for the city of Yoakum to raise their concern on this issue and press on to have these criminals sent to life or worse. Oh and my reason for that statement is. This crime could of easily been avoided. I read the Affidate and it states they assumed the house was unoccupied. Well why didn't they just turn around when they saw my family sleeping? Why did they wake up my cousin and maliciously attack him? Obviously he was fighting for his life and had to flee, and who else to go to than the man of the house, My grandfather. It takes "Effort" to load 2 shotgun rounds into the chamber, it takes "Effort" to pump a round and it takes "Effort" to pull the trigger. So again he knew what he was doing and the other guys stood around and probably egged him on, but they could of said "STOP" we are not here to do that! But did they? NO. So all are guilty by being on scene. So I ask the "Effort" to have these animals put away.

Unlike in some popular fiction, there is NO honor amoung thieves. They'll rat each other out if caught, they'll cry that the were innocently at the scene and had no idea what was going to happen. They're cowards who are only brave when in a gang and have the very young or the very old as victims. They're thugs, scum and sadly, still have the right to live until a jury convicts them of capital murder. Then a scummy lawyer will delay execution for years. It's disgusting.

To hell with these punks. What if the rolls were reversed what if someone broke into his house and took something he worked his A$$ for, would it be ok for someone to take it from him......... NO!! My grandfather is buried because of this act. What can they do to my family and me to make up this mistake? ABSOLUTELY NOTHING. My grandfather is gone.
