Man this is as dumb as it gets.... i worked at speedy stop when she tripped over the cat and i so saw her a few days after this happend and she looked fine to me she was walking normal and working... and i know for a fact shes not getting fired for being white or old she knows what she did was wrong and shes just trying to turn everything around so she doesnt look like the bad person, ive caught her in so many lies so i know not to believe anything she says

This is almost as bad as filing as lawsuit against GM because a driver of an 11 year old vehicle, who was not wearing a seat belt, fell asleep, wrecked his vehicle, was thrown out of the vehicle and unfortunately died of his injuries. Horrible but not GM's fault. People are sue crazy. It's always someone else's fault.

Tripped over a cat ! Didn't see that one coming from reading the headline and first couple of paragraphs.
Anyhow, pay her the shift differential for graveyards if that is speedy stop policy. And maybe give her the sick pay and vacation pay she is due. Otherwise this case has little merit and she is wasting her time.
Griping about having to do her general job duties, what with the car wash labor and such, is not going to engender much sympathy. Sounds more like a personality clash with her supervisor and that happens all the time in lots of jobs and places. Just gotta find a way to work together or else go work somewhere else.

this lawsuit is not going to go nowhere on the job discrimination part but if the lawyer is smart enough he should nail it on the cat and fall incident---you know why---even though the cat did not belong to the store in question---but since it was known that some employees were feeding it ,,it becomes part of the store simple as they knew the cat was around and it was being feed becoming a liability to the business---

Age discrimination? She was hired at age 60 and fired at age 61 after abusing the manager. The manager could be the worst manager on the planet and this claim still isn't going to fly.
That said, the cat may have a claim against McCaskill.

Russell said the cat did not belong to Speedy Stop, HOWEVER, the store managers had been feeding it... AND...
McCaskill was on a smoke break at the time of the fall and not actually on the job.
It is Speedy Stop policy employees clock out whenever they go on breaks, whether, it is for a smoke break or to go to the latrine.
