Woman gets settlement for injuries suffered in wreck

A Victoria County woman will receive $4,278 in damages for injuries she suffered in a May 2008 wreck.

Maraiavela Sierra was awarded the damages at the conclusion of a one-day jury trial Tuesday.

Sierra received $4,278 for past medical expenses and past physical pain and mental anguish.

She received nothing for future expenses.

District Judge Joseph Patrick Kelly presided over the trial.

Sierra filed the lawsuit against defendant Loretta R. Hampton in district court in May 2010.

The lawsuit contends that on May 20, 2008, Sierra was traveling north in her Ford Escort in the 3300 block of South Laurent Street, while Hampton was westbound in her Ford Taurus on the U.S. Highway 59 frontage road.

Hampton's Taurus struck the right side of Sierra's Escort when the Taurus failed to stop at a stop sign located at the intersection of South Laurent Street and the U.S. Highway 59 frontage road.

Sierra alleged that Hampton's actions proved negligence for several reasons, including Hampton's failure to yield the right of way to the plaintiff; failure to stop and obey a stop sign; failure to apply the brakes in order to avoid a collision; failure to pay attention while operating a motor vehicle; failure to make a proper turn; and her reckless driving with disregard for the safety of a person or property.

Sierra claimed to have suffered serious bodily injures, including injury to her knee, soreness, limitation of motion and extreme pain, all of which appear to be permanent.

Hampton denied any wrongdoing in a formal response filed in June 2010.

The plaintiff was represented by Houston-based attorney Robert G. Gibson, while Hampton is being represented by Corpus Christi-based attorney Thomas A. Silver.

  • I have had 4 car wrecks which were not my fault. On 3 I contacted a lawyer like I was told. I got about $500 for each accident. on the 4th accident I contacted the insurance company of the other driver and made a deal with them and got $6,000. I just by passed the lawyers and made a deal with the insurance company. Try it if you have a small wreck and no major physical damage.
