A Victoria man attacked a deputy in the courtroom Tuesday morning after a judge sentenced him to jail for failing to pay child support.
Adolph Gutierrez, 35, was also charged with assault of a public servant and resisting arrest for his actions in the court room.
He has to serve in jail until the child support is up to date.

You mean they actually jail parents for non payment in Victoria County? I was wondering since my ex owes 32 grand and they won't jail him no matter how many times I go to that kangaroo court. We just had a judgement put in place and at the first hearing he was read his rights and told if he didnt pay he would go to jail. Here we are 4 months later and nothing!!! I have filed a formal complaint with Austin and I am transferring my case OUT of Victoria County. Jack Ass Deadbeats....

December 16, 2011 at 7:48 a.m.poor stupid guy he just wanted to go home for the holidays! they should beat him for his stupidity!
December 15, 2011 at 7:48 p.m.Congrats TxBohemian. Job well done. I wish more parents, especially single dads, could follow your example.
Back to vision though. Seems to me it's a little beyond "thou shall not judge", and more into making excuses for. vision, do you personally know this person? you seem to have a vested interest in his reputation.
Concerning not knowing his situation and judging. I can agree insofar as it goes concerning his deadbeat dad status. Maybe he is unable to pay the amount set with his check, maybe he was laid off, maybe he really is a deadbeat. Who knows? Not I.
But striking the officer?
That by itself is ALL I need to know.
There is no excuse
There is no justification
There is no background or situation that would warrant such actions and behavior. That one action alone makes him a grade "A" Moron in any book.
You wrote, " if you have been reading the news all around people seem to be at their breaking points and no one knows what the discussion was. Yes it was a very stupid mistake but again you dont know at what point he was at."
Yes people are at their breaking points. Some even grab guns and go on a shooting spree. Better not judge them should we? And I don't care WHAT point he was at. there is NO EXCUSE PERIOD! What part of that point do YOU not get?
A thousand atta boys can be erased by a single Ahh SH**!
December 15, 2011 at 5:37 p.m.Awww, thanks JB.
Yeah there were times that were tougher than normal, but I'm sure any "Beaver Cleaver" family has those too.
I'll admit my kids were real good all the way through (or maybe I didn't want to see the bad things) even the dreaded "teen" years weren't that bad, even with 2.
One thing that kept me going was realizing they were way better off with me than the so called "mom" that left them. I have stories that would curl your hair when she was around.
Retired? Not yet, 10 years hopefully.
December 15, 2011 at 4:28 p.m.This person seems to have a history of poor choices. Times are tough but when you are a parent you have one priority. Be a good parent. Not supporting your child will not go on the "Good Parent" list.
Then he has a need to attack a deputy to show how he will grown up and be a parent. He has no justification for his actions. If he takes the same attitude in jail there may other problems ahead for him.
December 15, 2011 at 3:10 p.m.How about that!!!
After reading posts from TxBohenian for all this time, I pitured a retiree who life had been pretty good to. I never would have imagined a single dad trying to cope with all the tough things most Dads never have too.
I'm betting there were a few days in there when you came home and thought to yourself, "Is this $&!# ever going to end"?
Congrats TxBohem...Job well done!

"you do know that not everyone in child support doesnt pay..."
I know this VERY well, read below.
"Dont know if you have ever gone through what this person has gone through? If you have no idea you really should not judge anyone for their actions."
I have gone through this so I know all about child support and deadbeat parents.
I attained custody of my 2 kids (1yr old son and 2-1/2 yr old daughter), and my ex-wife (yeah, ex-WIFE) was supposed to pay child-support.
I never saw a dime!
Was it a struggle? You bet!
Would the extra money have helped? Your darn tootin' it would've!!
After about a year she quit coming around for visitation and some time later I terminated her rights. This was one of the best things I could've done!
Still didn't put any extra money in my pocket so, yeah, it was still a struggle.
The son is now 28 and the daughter is 30 and they are the best, well adjusted, young adults I know.
The daughter has a 1-1/2yr old son and is the best mom I've ever seen!
Am I patting myself on the back? You bet, cause this is pretty much all me!!
I did have help and support from my family but it was me in the day to day (everyday) routines, school activities, growing issues, etc...
So yeah, I've gone through this.
December 15, 2011 at 2:29 p.m.FrancesG, In addition to serving time for the back child support, for attacking a public servant, Gutierrez faces a bond of $50,000 and for resisting arrest there is a bond of $2,500.
December 15, 2011 at 1:52 p.m.If anything tx if you have been reading the news all around people seem to be at their breaking points and no one knows what the discussion was. Yes it was a very stupid mistake but again you dont know at what point he was at. you do know that not everyone in child support doesnt pay. some get behind and cant catch up. Dont know if you have ever gone through what this person has gone through? If you have no idea you really should not judge anyone for their actions.
December 15, 2011 at 12:15 p.m.You're right vision, we shouldn't judge.
I saw this on TV last night, could someone please tell me what was this guy thinking??
I mean he was in a court room with cameras and a dozen or so witnesses!!
Did he think they were going to let him go and he was just going to walk out??
Yes, I made some bad choices throughout life, but this goes well beyond a bad choice, this is just really stupid!!
December 15, 2011 at 11:59 a.m.He obviously will serve....but you should not judge this man you dont know his life or his circumstances. Yes hes made some bad choices but havent you ever made some bad decisions?
December 15, 2011 at 11:30 a.m.I know of one deadbeat dad that was in custody for another crime in Jackson County that is over a year behind on child support and has not shown up for any court dates on the child support. And, guess What???? After serving time for the first crime he was let out even though they had a warrant for the child support. What is up with our justice system? I hope this guy doesn't get away with assaulting a peace officer or not paying all of his child support.
December 15, 2011 at 8:07 a.m.Way to go Judge, more should go to jail until their child support is paid in full. to many get away with it, and the children suffer for it.
December 15, 2011 at 7:53 a.m.Acting like animals in the courtroom from not paying child support will not solve the problem. Hope they stay longer for attacking an officer.
