I don't know, Familyman. Texas is a free-roam state...at least as far as cows are concerned. And yes, free-roam, as crazy as it is, means the cows have the right to roam on the highways!
The owner of the horse should be responsible for the damages because it was his horse that got out of the fence. It is his job to keep the animal contained.
