This story warms my heart. It is gratifying to see a company willing to take on the Federal behemoth, rather than rolling over and playing dead at the threat of a lawsuit. Go get 'em, Gate Guard Services; you are fighting the good fight. Tell the bureaucrats they can shove their unfair, abusive policy where the sun don't shine.
@ willWhat are true contractors? In your post you said if they are told when to show up and leave they are not contractors? Isn't that true of all contractors? I'm confused. I thought contractors are under the direction of who hired them.
guess what, the fire dept and ems had the same problem and guess what. they won. if the company tells them to be there at a certain time and when to leave, they are not contractors. Gate gard just doesn't want to pay taxes and other benefits. good luck, if the municipalites lost, the oil service company do not stand a chance.PAY CESAR!

These "employees" do little or nothing, and now they want to use Federal laws to screw their employers? Payback is a tough. Just wait for the oilfield to employ electronic monitoring rather gate guards.
They should consider themselves fortunate to have a job, to be employed. There are many, many, many (like myself) that would love to be employed and bringing in some money.
This stinking new age oil field sux! This is a classic example of these new to the industry people trying to change the way the oilfield has worked for decades to make it better for themselves. If you want an hourly paying job you get a hourly pay. if you want a salary paying job you get a salary. if you except to become a contract laborer and then find you can't make it on what you agreed upon you made the mistake not the company. If you agree to take a job for any amount of money thats what you get. You don't came back later and holler foul I want more. Creeps GET OUT OF OUR OILFIELD AND LEAVES US ALONE! WE WERE DOING FINE WITHOUT YOU!
