The Lavaca County Commissioners Court officially accepted the resignation of Justice of the Peace Precinct 2 Fred Nieto on Monday.
Nieto, who submitted his resignation on Aug. 31, is under investigation by the Lavaca County District Attorney's Office for business activities at his now-closed used car business.
A recent audit of Nieto's county operations revealed no improprieties, reported County Judge Tramer Woytek.
Nieto will continue to serve in the office until his replacement is named.
The court also appointed a selection committee to screen applicants for the position. Woytek, Precinct 2 Commissioner Ronald Berckenhoff, Precinct 2 Constable Charles Greive and County Auditor Shana Opela will serve on the committee.
Applications for justice of the peace will be taken until Oct. 12.
Nieto also recently was fired from his job as Moulton municipal judge. He was placed on unpaid administrative leave in August shortly after the investigation began.
