Mistrial declared in assault case

A mistrial was declared in an assault trial against a Victoria man.

The trial began and ended on Tuesday. It has been reset for July 18.

Adolph Frank Gutierrez, 35, is charged with third-degree felony assault of a public servant.

In December, Gutierrez struck a Victoria County Sheriff's Office deputy's arm with his hand, according to a February indictment.

The defendant was represented by defense attorney James Beeler.

The Victoria County District Attorney's Office is prosecuting the case.

District Judge Robert Cheshire presided over the case.
