Court documents reveal possible motive for Goliad man's death

Three men charged with killing a 38-year-old Goliad man may have done so over a perceived insult by the victim to the wife of one of the defendants.

According to court documents released Wednesday, last year, at a party at Torivio Gutierrez's house, Christoval Lee Garza made remarks about Gutierrez's wife being "hot."

Gutierrez was overheard saying, "I'll get his --- later on, one day," in response to the perceived insult.

Garza was found dead outside Gutierrez's home in the 1200 block of Warrick Road, behind the grain elevators, about 5 a.m. July 4.

Endalesio R. Pompa IV, 29, of Goliad; Louis Michael Flores, 49; and Gutierrez, 41, have been charged with murder in connection with Garza's death.

The defendants, the victim and a fifth man, Alex Guerra, were drinking together at the River Bottom Tavern on Courthouse Square from 10 p.m. to midnight July 3. When the bar closed, the five men went to Gutierrez's home to continue drinking.

Guerra rents a recreational vehicle from Gutierrez, and it was between their homes that Gutierrez confronted Garza about the perceived insult from last year, according to the court affidavit.

"You're the one talking ---- about my old lady," Gutierrez said to Garza, according to court documents.

Gutierrez began punching Garza. Flores and Pompa also began punching Garza. Guerra told investigators he stayed out of the fight, saying, "I don't want no part of this ----."

Garza fell to the ground, where Gutierrez, Flores and Pompa repeatedly kicked him. An autopsy revealed Garza suffered blunt force trauma to the abdomen and back, which fractured his ribs, punctured his left lung and lacerated his spleen.

The investigator, Sgt. John Pape with the Goliad County Sheriff's Office, received conflicting accounts of what happened on the morning of July 4, according to arrest warrant affidavits.

Flores and Gutierrez were arrested July 15. Pompa was arrested the following day.
