Lavaca County District Attorney Heather McMinn met with Ranger Evans and Sheriff Harmon to review the investigation and discuss further action. “ At this time I believe the homicide investigation should be sent to the grand jury. Sheriff Harmon made the right descion in not arresting the father at the time of the incident. All of the evidence surrounding this homicide will presented to the Grand Jury as soon as possible.” Sheriff Micah Harmon indicated that he believed the child’s father was very remorseful and did not intend to kill Jesus Mora Flores. “ This case has been very traumatizing on the child, her father, and his entire family. I’m thankful the investigation is complete and that the District Attorney will be presenting it to the grand jury next week.”

Here is a copy of the press release issued Friday by the DA (I have to split it in two parts because of the word length on comments):RE: Homicide in Lavaca County on Saturday June 9, 2012From Lavaca County Sheriff's Office On Saturday June 9, 2012 at approximately 3:43 p.m. the Lavaca County 911 emergency service received a call from a distraught man urgently seeking medical care for a man who had been assaulted. The caller described that the man was in need of immediate medical care from injuries he sustained from the father of a five year old child the man was attempting to sexually assault. Upon arrival at the rural location outside of Shiner, Texas law enforcement and emergency medical personnel observed Jesus Mora Flores, D.O.B 11/08/1964, who appeared to have suffered numerous injuries to the head and neck area. Upon talking to witnesses at the scene, law enforcement discovered that a witness observed Jesus Mora Flores forcibly carrying a five year old child off to a secluded area, the witness ran for help and alerted the child’s father. The father immediately rushed to the area and began calling for his child. At that time the father heard the child scream. The father ran in the direction of his child’s cry and came upon Jesus Mora Flores attacking his child. The father immediately removed Jesus Mora Flores from on top of his child and in the process inflicted several blows to the man’s head and neck area. Sheriff Harmon stated that “the physical evidence at the scene appeared to substantiate the father’s account: When emergency medical personnel arrived, Jesus Mora Flores pants and underwear were down and the man’s genitals were exposed.” Further investigation, which was assisted by the Texas Rangers, included an autopsy, a physical exam of the child, a forensic interview of the child, and several detailed witness statements. All of the physical evidence and the witness statements corroborated the father’s statement. Sherriff Harmon expressed his appreciation of the Ranger’s assistance. “despite the other factors involved this is still a homicide investigation and I appreciate the Ranger’s assisting my office in completing the investigation.” “The family and the witnesses were very co-operative with law enforcement and several met with Texas Ranger Evans for follow up detailed interviews.”...
