There has been a lot of discussion on here about the US/Mexico Border and whether or not to put the military on it or bring the National Guard in.  I know first hand that the military has already been on the border in New Mexico and Arizona since 2005.  The National Guard has been permanently assigned to all Border Patrol Stations now going on two years.  But there are two major dilemmas:

1.)  The US Military cannot carry loaded weapons directly on the US/Mexico border.

2.)  In Texas almost all the land is privately owned, especially along the border, and currently Federal Law prohibits the National Guard from entering onto these private lands, hence they cannot patrol the border.  They are allowed to back up Border Patrol Agents on Highways, Interstates, public roads, country roads, in the city, at checkpoints, and any public location in general, as well as at the stations.  They cannot detain, arrest, determine citizenship, ar question anyone in reference to immigration matters.  They are solely their to assist the Border Patrol in the event of a life/death situation, clerical work, vehicle maintenance, and roving public lands providing possible suspicious activity to BP Agents via radio com.

So saying "Let's just put the military on the border" is much more complicated than you could possibly imagine.
