EDNA — A man was found guilty on Friday of intoxicated manslaughter and sentenced to 60 years in prison for causing the death of a 12-year-old Ganado boy.

The verdict comes more than two years after the death of 12-year-old LaMarquis Lee, who died after he was ejected from a vehicle during an October 2019 crash outside his father’s home in Ganado.

Lee and his grandmother were returning home from a football practice at the time.

The driver of the other vehicle, Brian Gunter, 46, crashed into Lee’s vehicle traveling at 99 miles per hour — nearly double the posted speed limit, according to the evidence.

One hour after the collision, Gunter’s blood was taken and he was found to have a blood alcohol content of 0.129. The legal limit in Texas is 0.08.

District Judge Robert Bell presided over the trial in lieu of a jury. With the agreement of the defense and the state, Bell decided whether Gunter was guilty or not guilty and assessed the punishment.

Defense attorney Boyd Shepherd, of Houston, represented Gunter.

The case was prosecuted by Assistant District Attorney Stephen Tyler.
