Yorktown city administrator Marcus Puente was over the legal limit for alcohol when he fatally crashed his car earlier this month.

"Alcohol shows as a factor in the cause of the crash," said Trooper Gerald Bryant, Department of Public Safety spokesman.

Puente's blood alcohol level was at 0.22, said Bryant. The legal limit is 0.08.

Puente, 28, died when his car left Farm-to-Market Road 952 near the DeWitt County community of Cotton Patch on Dec. 1, according to the DPS report.

Puente had been city administrator since November 2009.

On Monday night, the Yorktown City Council appointed city's water superintendent Robert Mendez as interim city administrator, said Mayor Rene Hernandez.
