The owner of the dog that attacked an off-duty police officer dropped her appeal to challenge the dog being banned from the county.
Carrie McKittrick's Rottweiler bit the thigh of detective John Luna, of the Victoria Police Department, when he was jogging in his neighborhood near Timothy Street on Oct. 9.
This was the second time the dog had attacked him, Luna said.
The McKittricks were set to plead their case to Justice of the Peace Stuart Posey on Thursday but decided not to appeal at the last minute, Luna said.
McKrittrick could not be reached for comment.
The dog will be deemed a vicious animal and will not be allowed in the county by county ordinance.
